17-Year-Old Contested Divorce Victory at Delhi High Court After Fresh Legal Strategy

Background: A 17-Year Legal Battle for Freedom

 

Our client, a Delhi-based businessman, first approached us in November 2023 with a divorce case that had been pending for over 17 years.

He had originally filed a petition for divorce in 2008 before the Family Court at Karkardooma, Delhi, under Section 13(1)(ia) and (ib) of the Hindu Marriage Act, 1955, on the grounds of cruelty and desertion.

Despite having a strong factual case, with clear evidence of cruelty, prolonged separation, and absence of marital cohabitation, the Family Court dismissed his petition in 2019, leaving him devastated after more than a decade of litigation.

His earlier counsel had filed an appeal before the Hon’ble Delhi High Court, but no substantial progress was made for years. When he came to us, he was emotionally exhausted, financially drained, and convinced that justice would never come.

 

Our Intervention: Fresh Eyes, Fresh Strategy, and a New Written Submission

Upon reviewing the entire trial court record and the existing written submissions filed before the High Court, we immediately noticed a glaring issue: the written submissions were a verbatim copy of what had been filed before the Family Court.

There was no reference to the trial court’s reasoning, no analysis of contradictions in the respondent’s testimony, and no citations supporting his case under settled law.

After detailed conferences with the client and examination of evidence, we were convinced that his case had been lost not on facts, but on poor representation.

We sought liberty from the Hon’ble Delhi High Court to file a revised written submission, which was graciously allowed. Thereafter, we completely restructured and redrafted his submissions, focusing on both factual inconsistencies and legal precedents.

 

Our Legal Approach: Meticulous Drafting Supported by 22 Judgments

 

We drafted a comprehensive set of revised written submissions, running into 5 pages only, systematically addressing:

  1. Misappreciation of evidence by the Family Court.
  2. Contradictions in the cross-examination of the wife, proving false allegations of dowry demand and cruelty.
  3. Continuous desertion by the wife since 2007, with no intention of cohabitation.
  4. Mental cruelty caused by sustained denial of conjugal rights and unfounded complaints.
  5. Irretrievable breakdown of marriage, citing the long separation of over 15 years.

Each authority was contextually applied to the facts of our client’s case, demonstrating how the Family Court had failed to appreciate the settled legal principles and evidence on record.

 

Result: Delhi High Court Grants Divorce — Justice After 17 Years

 

After several rounds of hearing and detailed perusal of our revised written submissions, the Hon’ble Delhi High Court delivered its judgment in March 2025, allowing the appeal and granting divorce on the grounds of cruelty and desertion.

The Court noted that the marriage had broken down irretrievably, and the continuation of the marital tie served no purpose except to perpetuate agony. It also observed that the trial court had erred in overlooking critical evidence and that the revised submissions provided a comprehensive legal perspective backed by authoritative judgments.

This judgment finally ended a 17-year legal struggle, restoring our client’s dignity, peace, and freedom after nearly two decades of litigation.
