Mutual consent divorce requires both spouses to agree on dissolution and all ancillary terms β maintenance, custody, property. It is filed under Section 13B HMA or Section 28 SMA and typically resolved in 6 to 18 months (or 3β6 months with a cooling-off waiver). Contested divorce is filed when one spouse is unwilling or when there is a genuine dispute about grounds or terms. It involves a full trial process and can take 2β6 years depending on the forum and the issues contested.
A transfer petition is needed when a matrimonial case is pending in a court in one state and a party wants it moved to a court in a different state. The Supreme Court has jurisdiction under Section 25 CPC for civil cases (divorce, custody, maintenance) and Section 446 BNSS for criminal matters (498A, domestic violence). If both courts are within the same state, the High Court is the correct forum under Section 24 CPC or Section 447 BNSS.
